Welcome to www.slowouttravel.com (“the Website”).
These Terms and Conditions (“Terms”) govern:

  • Your use of the Website, and

  • All travel-related services, products, packages, and arrangements (“Travel Services”) offered by SlowOut Travel by Alberto Perez, a registered company in Switzerland (“we”, “our”, “the Company”).

By accessing the Website or engaging our Travel Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please discontinue use of the Website and our services.

2. Website Usage Terms

2.1 Cookies

The Website uses cookies to ensure proper functionality and enhance your experience. By using the Website, you consent to required cookies. Cookies may be used for analytics, performance, or embedded third-party content. Essential cookies do not require explicit consent.

2.2 Intellectual Property

Unless otherwise stated, all Website content is the property of SlowOut Travel by Alberto Perez and/or its licensors.
You may not:

  • Copy, reproduce, republish, or redistribute Website material

  • Sell or sub-license Website content

  • Use Website content commercially without prior written approval

2.3 User Comments

Users may post comments where allowed. Comments represent user viewpoints, not the Company’s. We may remove any inappropriate or unlawful content.

Users represent and warrant that their submissions:

  • Do not violate third-party rights

  • Are not defamatory, offensive, or unlawful

  • Are not used for solicitation or advertising

Users grant us a non-exclusive license to reproduce, edit, or use submitted comments.

2.4 Hyperlinking

Certain organizations (e.g., government agencies, search engines, news outlets) may link to the Website without prior approval. Additional organizations may request approval. Links must not misrepresent affiliation or harm our reputation.

3. Scope of Travel Services

The Company provides:

  • Travel planning

  • Itinerary design

  • Travel consulting

  • Intermediation with third-party providers

  • Sales of travel packages and individual travel services

  • Personalized boutique travel arrangements

Specific conditions for each booking, package, or itinerary are stated in the corresponding quote, confirmation, or service agreement. These specific terms complement and supersede general Terms where applicable.

4. Bookings, Deposits & Payments

  • A booking is considered confirmed only after written acceptance and receipt of required payment(s).

  • Travel-agent service fees, consultation fees, and any non-refundable deposits are strictly non-refundable.

  • For packaged services, deposits and payment schedules will be communicated in your quote.

  • Prices are in CHF unless otherwise specified.

5. Cancellations, Changes & Refunds

5.1 Company-Initiated Changes or Cancellations

We reserve the right to make changes to your arrangements at any time. Most changes are minor, and you will be informed promptly.

We may also cancel a booking when minimum participant numbers are not met.

We will not cancel your booking within 8 weeks of departure, except for:

  • Force majeure

  • Failure to pay the final balance

  • Unforeseeable operational circumstances

If your booking is cancelled by us, you may choose:

  • A full refund, or

  • An alternative arrangement of comparable standard (with a refund of any price difference if lower)

5.2 Air Tickets

We do not provide air tickets as part of our packages. If occasionally arranged, such tickets are provided only as a customer courtesy and are not part of any package. No compensation, refund, or liability applies to air tickets.

5.3 Force Majeure

We are not liable for changes or cancellations due to events beyond our control, including but not limited to:

  • War, riots, strikes

  • Industrial disputes

  • Epidemics/pandemics

  • Weather conditions

  • Natural disasters

  • Transport technical issues

  • Delays caused by airlines, boats, or strikes

No compensation is payable in such circumstances.

6. Customer-Initiated Cancellations

All cancellations must be submitted in writing by the person who made the booking.

Standard Cancellation Policy

  • 20% non-refundable deposit

  • 50% cancellation fee (incl. deposit) if cancelled 30–21 days before arrival

  • 75% cancellation fee (incl. deposit) if cancelled 20–15 days before arrival

  • 100% cancellation fee if cancelled 14 days or less before arrival

Important:
Some hotels, museums, transportation providers, and special services require 100% payment at the time of booking. These bookings are fully non-refundable from the moment of purchase.

Refunds are only possible if permitted by the provider and the booking terms.

7. Complaints

If an issue arises during your trip, you must notify us immediately to allow a prompt resolution.

If unresolved during travel, submit a written complaint within 28 days of return.

Failure to report issues on-site may reduce your rights.

If a dispute cannot be settled amicably, you may pursue arbitration in accordance with Swiss law.

8. Liability

8.1 Packages

If a package booked with us is not performed as agreed due to our or our suppliers’ fault, you may be entitled to compensation—unless the failure is due to:

  • Your own actions

  • A third party unrelated to the arrangements

  • Force majeure or unforeseeable circumstances

Our liability (except for injury, illness, or death) is limited to a maximum of twice the invoice amount.

International conventions (Montreal, Athens, Berne, Paris) may further limit compensation levels.

8.2 Accommodation-Only Services

We exercise reasonable care in selecting accommodation providers.
We are not liable for events occurring at accommodations unless proven that we failed in our selection duty.

Liability does not apply where:

  • Circumstances beyond our control prevent provision

  • Losses were not foreseeable

  • Losses relate to business activities

  • Losses concern services not included in our contract

Maximum liability is three times the accommodation cost, except for injury/death.

9. Insurance

Travel insurance is mandatory and entirely the customer’s responsibility.

We strongly recommend coverage for:

  • Trip cancellation

  • Medical expenses

  • Baggage loss

  • Delays or disruptions

We accept no liability for a customer’s failure to obtain adequate insurance.

10. Customer Responsibilities

10.1 Documents

Passengers are solely responsible for:

  • Valid passports

  • Visas

  • Entry requirements

  • Driver’s licenses

  • Travel permits

  • Other mandatory travel documents

We cannot be held liable for costs arising from failure to meet these requirements.

10.2 Personal Safety & Conduct

Guests must behave respectfully and follow local laws and supplier guidelines.

We may terminate services without refund if behavior:

  • Endangers others

  • Causes distress or property damage

  • Violates laws or regulations

Customers must cover any resulting costs, damages, or legal claims.

10.3 Lost or Stolen Items

The Company is not liable for:

  • Lost, stolen, or damaged belongings

  • Items misplaced during tours, transfers, or accommodation stays

11. Health & Safety

We prioritize safety and work with qualified providers. However:

  • Standards abroad may differ from Swiss norms

  • Guests must exercise reasonable caution

  • Familiarize yourself with fire exits and local safety measures

  • Use hotel safes when available

The Company is not responsible for incidents resulting from negligence, disregard of instructions, or local conditions outside our control.

12. Flight Delays

Flight delays are outside our control.
We will support communication and adjust arrangements where possible, but we are not liable for delays, missed connections, or resulting costs.

13. Governing Law & Jurisdiction

These Terms are governed exclusively by Swiss law.

The courts of Zürich, Switzerland, have exclusive jurisdiction unless Swiss mandatory law provides otherwise.

14. Disclaimer

To the fullest extent permitted by Swiss law, we exclude all warranties related to the Website and Travel Services, except where exclusion is prohibited by law.

This disclaimer does not limit liability for:

  • Fraud

  • Death or personal injury caused by negligence

  • Any matter that cannot be legally excluded under Swiss law

As long as the Website is provided free of charge, the Company is not liable for any resulting loss or damage.

We may update these Terms at any time. Continued use of the Website or our services constitutes acceptance of the latest version.
